1. Acceptance of Terms

By signing up for, accessing, or using Takneek Social (“Service”), available at https://social.takneek.in, provided by Takneek, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service (“Terms”) and our Privacy Policy.

If you are entering into this agreement on behalf of a company, clinic, firm, or agency, you represent that you have the authority to bind such entity to these Terms.

2. Free Trial, Billing & Subscriptions

• 14-Day Free Trial: We offer a 14-day fully-featured trial without requiring a credit card or payment upfront. You can create calendars, generate branded visuals, and link your accounts.
• Paid Subscriptions: Following the trial, continued access to scheduling, multi-account publishing, and AI generation requires an active subscription plan (paid monthly or annually).
• Payment Methods: Subscription fees are charged in Indian Rupees (INR) via UPI, Net Banking, debit/credit cards, and supported payment gateways.
• Cancellation: You may cancel your subscription at any time through your dashboard. Your access will remain active until the conclusion of your current prepaid billing cycle.

3. Responsible Use & Platform Guidelines

You agree to use Takneek Social only for legitimate business promotion and authentic marketing. You must not:

• Publish content that violates copyright, trademark, privacy, or publicity rights of any third party.
• Distribute spam, deceptive advertising, unauthorized promotions, hate speech, or defamatory material.
• Violate the terms and community standards of connected third-party platforms, including the Meta Terms of Service, the Instagram Community Guidelines, and the Google Business Profile Policies.

4. Intellectual Property Ownership

Your Content: You retain 100% ownership and intellectual property rights in all images, logos, copy, videos, and materials you upload or approve for publishing through Takneek Social. We claim no ownership over your brand assets.

Takneek Platform: All software, design systems, algorithms, user interfaces, documentation, and source code powering Takneek Social remain the exclusive property of Takneek.

5. AI-Assisted Content Generation

Takneek Social includes generative AI capabilities for drafting captions, suggesting hashtags, planning content calendars, and generating custom brand imagery.

• AI outputs are suggestions and creative drafts intended to assist your workflow.
• Client Review: You remain solely responsible for reviewing, proofreading, and approving all AI-generated content before scheduling or publishing it to your public social channels.

6. Limitation of Liability & Disclaimers

Takneek Social is provided on an “as is” and “as available” basis. While we strive for maximum uptime and reliable publishing, we cannot guarantee uninterrupted access or that third-party APIs (Meta, Google, YouTube) will not experience technical interruptions, token expirations, or policy modifications outside our direct control.

To the fullest extent permitted under applicable law, Takneek shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from your use of the Service.

7. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any disputes arising out of or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts in Bhopal, Madhya Pradesh, India.
